§ 44-100. Prohibited vehicle operation.

  • (a)

    Parks, sidewalks and bike paths. No person shall drive any vehicle other than by human power upon a bike path, sidewalk, or sidewalk area (except upon a permanent or duly authorized temporary driveway) or upon any city park property not designed for vehicular use.

    Exceptions.

    a.

    Sanctioned events permitted or allowed by the city and/or authorized by the city manager or his designee.

    b.

    Use by city employees and/or persons contracted by the city to work on or maintain aforementioned areas.

    c.

    Use by emergency personnel while in the performance of their duties.

    (b)

    Use of engine or exhaust braking prohibited.

    (1)

    It shall be unlawful, except to avert imminent danger, for any person to use a compression release type engine brake or exhaust brake unless the blowdown from the compression release and the exhaust of any internal combustion engine is discharged through an appropriate muffler system before entering the ambient air.

    (2)

    For the purpose of this section, use of a compression release type engine brake shall be defined as a device which, when activated, retards one or more pistons on the engine of the motor vehicle in order to assist the motor vehicle in braking, and in the process of doing so creates a loud and offensive noise from the motor vehicle when inadequately or improperly muffled. An exhaust is any device that restricts the flow of exhaust from the engine, creating back pressure to the engine therefore causing the engine to retard.
