§ 12.4. Board of adjustment; creation and composition; terms; officers; etc.

  • (a)

    Creation and composition. As part of the zoning ordinance, the council shall create a board of adjustment. The board of adjustment shall have not less than five (5) nor more than ten (10) members. Members of the board of adjustment shall be appointed by the governing body. In addition, the governing body may appoint not more than two (2) alternate members, designating them as such. Such alternate members may act in this temporary absence or disability of any regular member, or may act when a regular member is otherwise disqualified in a particular case that may be presented to the board. No member or alternate member of the board of adjustment shall be a paid or elected official or employee of the governing body involved, except in the event that a quorum cannot be obtained at a board of adjustment meeting, in which case a councilmember as designated by the city council may serve as an alternate board of adjustment member in place of an absent regular member in order to make a quorum.

    (b)

    Terms of office, removal from office, vacancies. Members of the board of adjustment shall serve for overlapping terms of not less than three (3) years or more than five (5) years or thereafter until their successors are appointed. Not more than a minority of the terms of such members shall expire in any one year. Any member of the board of adjustment may be removed from office for cause by the council upon written charges and after public hearing. Any vacancy occurring during the unexpired term of office of any member shall be filled by the governing body for the remainder of the term. Such vacancy shall be filled within thirty (30) days after the vacancy occurs.
